Terms and Conditions for Activeliving4all Services and Training.

1. Minimum Commitment:
-
All clients are required to commit to a minimum of 6 months of training/nutrition services. This commitment ensures optimal results and allows for a well-structured training and nutrition plan to be developed and implemented.

After the initial 6-month period, either party may terminate the agreement with a 30-day written notice.
​
2. Payment Terms:
-
Payments for nutrition, personal, and group training services are due between the 25th and 29th of each month for the upcoming month.
-
Payments must be made in advance and are non-refundable once processed.
-
Payments must be made via EFT, and the agreed-upon amount will remain consistent throughout the duration of the agreement unless otherwise agreed upon.

3. A Month Is a Month:
-
A "month" for the purposes of this agreement refers to a calendar month (1st to 30/31st), and each month will be charged in full, regardless of the number of training sessions or the length of the month.
-
This means that shorter months (e.g., February) or months with public holidays will not receive any session discounts, and no adjustments will be made to the monthly payment for such reasons.

Session fees will remain the same each month, regardless of these factors.

This policy applies to all months, including January and December each year. Regardless of holidays or personal travel, a "month" is considered a full calendar month, and no discounts or adjustments will be made for shorter months or holiday periods.

During January and December, when regular in-person sessions may be impacted by holidays, we will provide holiday/home training programs and nutrition plans to ensure you can continue your progress. These plans will be discussed and provided in advance, allowing you to stay on track during the holiday season.

4. Cancellation and Termination Policy:

To cancel or terminate training services, a minimum of 30 calendar days' notice is required. This applies to all nutrition, personal, and group training sessions.

If a client wishes to cancel their training package before completing the 6-month commitment period, they will still be liable for the full remaining fees for the 6-month term.

After the initial 6-month period, services can be cancelled with a 30-day notice, and no additional payments will be required.

5. Rescheduling/Cancellation of Sessions:

To reschedule any session, a minimum of 24 hours’ notice is required. Sessions not rescheduled within this time frame will not be rescheduled or refunded, as the time slot is held exclusively for the client.

We understand that emergencies and unexpected situations arise, and if you need to reschedule, please notify us as early as possible, and we will try to accommodate where possible.

Sessions cancelled by the client and not rescheduled will be forfeited.

6. Public Holidays:
-
If a scheduled session falls on a public holiday, we will assist in rescheduling the session to another available time within the same month.

If rescheduling is not possible, the session will be forfeited. No discounts or adjustments will be made to the monthly fee for public holidays, and the session will not be "caught up" in another month.

We will make every effort to accommodate rescheduling requests, but please note that availability may be limited.

7. Annual Fee Increase Policy:

To account for inflation and rising operational costs, all clients will receive an annual fee increase of 5% on their training fees, regardless of where they are in their commitment period.

This increase will take effect on June 1st each year. The updated fees will apply to all clients and will be due at the end of May for June.

Clients will be notified of the upcoming fee increase in advance, and the new fee structure will be applicable to all ongoing services, regardless of whether the client is within their initial commitment period or after it has ended. This ensures the fee adjustment is consistent for all clients.

8. Business or Holiday Travel (Client’s Side):

If you are unable to attend or reschedule a scheduled session due to business or holiday travel, please note that these sessions cannot be rescheduled or caught up at a later date.

The session will be considered forfeited, and no refund will be provided. We encourage you to plan your travel around your training schedule whenever possible.

If you are traveling, online or independent pre planned sessions can be arranged and completed remotely. Please notify us in advance if you'd like to switch to an online or independent session during your travels.

Sessions missed due to personal travel that are not conducted online, independently or with prior rescheduling are not eligible for refunds.

9. Trainer/Mentor Travel Policy:

In the event that your trainer or mentor needs to travel for business or personal reasons, prior arrangements will be made to ensure that your training or mentoring sessions are not disrupted.

Clients will be provided with either a pre-programmed session to complete independently or an adjusted online session that can be conducted remotely.
-
We will make every effort to schedule these travel periods to coincide with general holiday periods or times that are least disruptive to your regular training or mentoring schedule.
-
However, if the trainer’s travel falls outside of these periods, you will be notified well in advance so that appropriate arrangements can be made.

In cases where online sessions are not feasible or if a programmed session is not suitable, we will discuss alternative solutions with you to ensure continuity of your progress during the trainer's absence.

10. No-Show Policy:

In the event of a "no-show" for a scheduled session without prior notice, the session will be forfeited, and no refund or rescheduling will be provided.
-
Consistent no-shows with no prior arrangement may result in the suspension or termination of training services, as it impacts the overall schedule and availability of trainers.

11. Trainer Availability and Adjustments:

If a trainer is unavailable due to illness, emergency, or any other reason, you will be notified promptly. We will work with you to reschedule the session at a mutually convenient time or complete the session online.

We strive to ensure continuity of service and will inform you of any changes in advance.

12. Health and Safety:
-
You acknowledge that you are physically capable of engaging in fitness activities and will inform your trainer of any existing health concerns, injuries, or limitations.
-
Your training program will be customized to meet your individual needs, and modifications will be made where necessary.
-
It is essential that you communicate any health concerns to your trainer to ensure your safety during sessions.

13. Confidentiality and Privacy:

We respect your privacy and ensure that any personal information provided to us, including health details and payment information, is kept confidential.
-
We will not share your personal information with third parties without your consent, unless required by law.

14. Liability Waiver:

By participating in personal or group training services, you acknowledge that there are inherent risks involved in physical activity.
-
You agree to release the trainer and any associated parties from liability for injuries, accidents, or damages sustained during training sessions, except in cases of proven negligence.

15. Termination of Services:

We reserve the right to terminate any training agreement if there is a consistent failure to adhere to the policies outlined in these terms and conditions, including but not limited to repeated cancellations, no-shows, or failure to pay.

In such cases, any remaining sessions will be forfeited, and no refund will be provided.

16. Adherence to Training Facility Rules and Regulations:

Clients are expected to comply with all rules and regulations established by the training facility. These rules are designed to ensure the safety, well-being, and smooth operation of services for all clients and staff.

Failure to adhere to these rules may result in suspension or termination of services.

Please follow the designated areas for training, equipment usage, and hygiene protocols as specified by the facility. Clients are encouraged to respect other users and staff to maintain a positive environment for all.

17. Results Disclaimer:

Individual results may vary. The success of this program depends significantly on your commitment, consistency, and personal effort. While we provide the tools, guidance, and resources necessary for progress, achieving desired outcomes is ultimately influenced by your level of participation and adherence to the program.

We make no guarantees regarding specific results, as these are determined by a combination of individual dedication, lifestyle factors, and engagement with the program materials.
By engaging in our Nutrition Services, personal or group training services, you agree to the terms and conditions set forth in this agreement.
